Lala.com Offers Online Music Sharing for iPod Users
The Palo Alto, California-based service straddles the area pioneered by peer-to-peer sites, portable digital music players, and music that is free of copy protection. Lala.com cofounder Bill Nguyen said in a statement that his company "wanted to create a service that blends the convenience of the Web with the portability and functionality of a truly universal platform."
Lala.com's approach is the third digital music revolution, he added, after Napster and the iPod. With it, users now can share songs "without the threat of PC viruses, spyware, and other risks that are present on illegal P2P sites." At present, there are no subscription fees or ads on Lala.com.
Success Depends on Labels
Any digital music can be hosted on Lala.com, the company said, although it is designed for downloading only to iPods. You can listen to all of your hosted library, via streaming, with any connected Mac or PC. You also can listen to the playlists that others have made, either composed of songs in the Lala.com music library or selections the libraries of other users.
Music can be purchased and downloaded to an iPod or purchased as a CD, but, at present, only songs from Warner Music Group are sold on Lala.com.
Lala said in a statement that it has an "agreement in principle" with Warner Music Group to make that record company's music available on the site. News reports indicate that talks are underway with other major music companies as well.
The success of Lala.com "is dependent on the participation of the other three major labels," said Susan Kevorkian, program manager of consumer markets at industry research firm IDC. "But they're off to a strong start."
She also noted that Lala, which is "well-funded," still has options for other kinds of revenues, such as subscriptions or ads.
Cofounder Nguyen has been quoted as saying that he expects the service to lose about $40 million in the first two years, with free-play licensing fees as high as $160 million during that time.
Lala's Charitable Side
Lala.com has created the "Z" Foundation, whose inspiration came from the creation of the Motion Picture Relief Fund and United Artists by Charlie Chaplin and others.
The Foundation receives monthly contributions of $10,000 to $50,000, depending on Lala.com's sales volume, and the money will be used to provide health and dental care for musicians in need. Currently, the Foundation's only income is generated by Lala.com's CD-trading activities, not its online music service.
The "Z" is in honor of Fr. Brian Zinnamon SF, a Jesuit priest who influenced the charitable work of Lala.com's cofounders, Nguyen and John Cogan.

YouTube to test video ID with Time Warner, Disney
The so-called video fingerprinting tools, which identify unique attributes in the video clips, will be available for testing in about a month, a YouTube executive said.
"The technology was built with the Disney's and Time Warner's in mind," Chris Maxcy, YouTube partner development director, said, adding that, since early this year, Google has been testing audio-fingerprinting tools with record labels.
These tools will be used to identify copyrighted material, after which media companies can decide if they would like to remove the material or keep it up, as part of a revenue-sharing deal with YouTube, which can sell advertising alongside it.
Once proven to work, the technology could be used to block the uploading of copyrighted clips, YouTube product manager David King said. It aims to make the tools widely available to any copyright owner later this year.
YouTube has come under fire from several other traditional media companies, which say it has dragged its heels in offering reliable ways to identify video clips uploaded by regular users without permission.
Unable to reach a distribution agreement, MTV Networks-owner Viacom Inc. sued Google and YouTube for more than $1 billion in damages in March, charging the company with "massive intentional copyright infringement" after demanding the removal of clips of its popular shows "Colbert Report" and "Daily Show," hosted by comedian Jon Stewart.
Media companies have eyed the wildly popular video-sharing site as a mixture of opportunity and threat as they seek to reach consumers wherever they spend time.
On one hand, they view YouTube as a powerful promotional medium to drive viewers back to television or their own sites. On the other, YouTube's traffic has soared as users upload copyrighted shows globally onto the service.
Nine months ago, YouTube said such tools would be made available to media companies for testing by the end of 2006. But the reliable identification of content has proved a complex task that required Google to develop its own technology tools.
Maxcy said other media companies planned to test the technology, but he declined to name these other parties. "There are a couple," he said, referring to Disney and Time-Warner. "There are more that we can't talk about right now," he said.
YouTube officials said they have quietly been testing ways to help identify the audio tracks of video clips with major record labels using technology from privately held Audible Magic as early as the first two months of 2007.
These tools will be made available to all content owners later this year depending on the results of the tests, YouTube executives said on Monday.
"It's typically not something we talk about," Maxcy said, adding, however: "We wanted to clear the air."
Maxcy said that over time, Google planned to add additional layers of technology to better spot content on its service.

NY man pleads guilty to spamming AOL subscribers
Adam Vitale, 26, pleaded guilty in federal court in Manhattan to breaking anti-spam laws. He was caught making a deal with a government informant that sent spam e-mails advertising a computer security program in return for 50 percent of the product's profits, prosecutors said.
According to prosecutors, Vitale and another man, Todd Moeller, defeated AOL's filter system by using several different computer servers to relay the e-mails and changed the e-mail header information to ensure the spam e-mails could not be traced back to them.
Moeller told the informant via instant messaging he had 40 different servers to send spam e-mails from and made $40,000 a month from other spam e-mails promoting stocks, court papers said.
The indictment said that in less than a week in August 2005, Vitale and Moeller sent e-mails on behalf of the informant to more than 1,277,000 addresses of subscribers at AOL, the online division of Time Warner Inc.
Vitale will be sentenced on September 13 when he faces a maximum sentence of 11 years in prison. Moeller, who lives in New Jersey, faces the same charges

Macintosh' name=c1> SEARCHNews News Photos Images Web' name=c3> Macintosh computer core with iPod media players and the upcoming iPhone, could let the company control how large numbers of people use the Web at a time when services and programs are increasingly Internet-based.
Jobs also said Apple would let outside developers create applications for the iPhone by tapping Safari, softening the company's previous position that the device would not support other software due to security concerns.
But investors were disappointed that Jobs -- known for his surprise announcements -- did not have bigger news to unveil -- and Apple shares sank nearly 3.5 percent, their biggest one-day fall in about four months.
"Apple always hits a home run, and when they hit a triple, it's a disappointment," said Gene Munster, an analyst at Piper Jaffray & Co. who has an "outperform" rating on Apple stock.
Consumers and investors have been particularly hungry for any iPhone news ahead of the product's June 29 launch for use on AT&T's wireless network.
Apple shares fell $4.30 to close at $120.19 on Nasdaq. The stock has doubled over the past year and has risen 10 percent in the last month.
Speaking at Apple's annual developers' conference in San Francisco, Jobs put Microsoft's dominant Internet Explorer browser squarely in his sights, saying that test versions of the new Safari 3 were twice as fast at loading Web pages.
"We would love for Safari's market share to grow substantially," Jobs said. Safari has 5 percent of the browser market compared to 78 percent for Internet Explorer.

The focus on Safari sets the stage for a new browser war nearly a decade after Microsoft knocked off pioneering rival Netscape by including Internet Explorer for free in Windows.
Analysts said Apple clearly hopes to replicate its success in making a Windows version of its iTunes media program, a move that helped drive sales of its iPod media players as well as Mac computers.
Soleil Equity Research analyst Shannon Cross said the availability of Safari on Windows would boost popularity of the software and encourage Web site creators to make their sites compatible with the browser.
"It should also help increase Apple's exposure to the Windows community and potentially attract a larger audience of switchers," Cross wrote in a research note.
Addressing concerns that the iPhone would not support programs not created by Apple, Jobs said independent developers could write application software for Safari, which is included in the multimedia device.
"It's an innovative new way to create apps for mobile devices ... and it gives us tremendous capability, more than has ever been in a mobile device," Jobs said.
ThinkEquity analyst Jonathan Hoopes said developers writing applications to run on Safari could have their software run on either a Mac or Windows-based computer. "That same app should be able to run on the iPhone," he said.
The bulk of Jobs' speech was dedicated to showing off new bells and whistles in the updated operating system, such as the inclusion of a program to let Mac users run Windows.
"It helps with market share and helps with customers that are on the fence trying to move to the Mac," Phil Schiller, head of Apple's product marketing, said in an interview.
After the event, Goldman Sachs raised its 12-month price target on Apple stock to $135 from $120, saying the company was poised to outperform expectations.
"Software remains Apple's biggest competitive advantage," analyst David Bailey said in a report.

Google complains to DoJ about Vista search
Stories posted to the Web sites of the New York Times (registration required) and the Seattle Post-Intelligencer Saturday first revealed that Google's complaint centered on Vista's built-in desktop search software, dubbed Instant Search. Google, said both newspapers, accused Microsoft of designing Vista to discourage users from running its indexing and search software.
Sunday, Google spokesman Ricardo Reyes confirmed the charge. "Microsoft's current approach with Vista desktop search violates its agreement with the government and hurts consumers." he said in an e-mail to Computerworld. "The search boxes built throughout Vista are hard-wired to Microsoft's own desktop search product, with no way for users to choose an alternate provider from these visible search access points. Likewise, Vista makes it impractical to turn off Microsoft's search index."
According to postings on Microsoft's support forums, the only way to completely disable Vista's search is to stop the Windows Search service in the Microsoft Management Console.
Microsoft disputed Google's charges. "We've been working with state and federal antitrust officials for the past two years to ensure that there are no problems with any of the features in Windows Vista," said company spokesman Jack Evans. "These desktop search issues were reviewed at length with regulators prior to the release of Windows Vista and resulted in more than a dozen changes at their request."

Vietnam frees prominent cyber-dissident
Binh, a former journalist, was one of Vietnam's first "cyber-dissidents," who used the Internet to spread pro-democracy views. In late 2003, he was convicted of spying and sentenced to seven years in prison and three years of house arrest. The court said he had committed espionage by gathering anti-government information and documents for overseas "reactionary organizations."
Binh's early release comes as Washington has grown increasingly concerned about the arrest and jailing of a number of dissidents in Vietnam.

National Security Council spokesman Gordon Johndroe said Vietnam's crackdown on expression was "out of keeping with Vietnam's desire to prosper, modernize and take a more prominent role in world affairs."
President Nguyen Minh Triet is scheduled to make a June 22 visit to the United States, the first by a Vietnamese president. After the White House formally invited Triet to Washington, Vietnamese Vice Foreign Minister Le Van Bang announced last week that Hanoi would release three dissidents before the two presidents meet. He did not say which prisoners would be released.
Binh was arrested in September 2002 for writing an article that circulated on the Internet criticizing a border agreement between Vietnam and China. A month earlier, he joined 20 others in signing a petition to government leaders demanding legal reforms to protect human rights and establish an independent anti-corruption body.
That same year, he also submitted written testimony to the U.S. Congress criticizing Vietnam's human rights record.
Binh left his job at the Tap Chi Cong San newspaper in 2001 after applying to form an independent opposition political party. The Communist Party, Vietnam's only political party, strictly forbids any calls for a multiparty system.
Last month, a Vietnamese court sentenced three pro-democracy activists to up to five years in prison apiece after convicting them of spreading subversive propaganda. The U.S. Embassy in Hanoi issued a statement saying it was "deeply troubled" by the convictions, and noting a "disturbing increase" in the harassment of dissidents.
In March, a Catholic priest was sentenced to eight years in prison for disseminating materials intended to undermine the government and communicating with anti-communist groups overseas.

Adobe offers new tools to run Web programs offline
On Monday, the company is introducing a public test version of its software, code-named Apollo, that helps programmers to write advanced programs called Rich Internet Applications (RIA) for desktop computers, even when not connected to the Web.
"Apollo is for when developers want to take online applications and make them work offline on a computer," Michele Turner, Adobe's vice president of platforms, said in a phone interview. "We don't think the browser is going to go away."
Consumers stand to benefit from a more flexible generation of Web software that works both online and offline and comes from a wide range of independent software makers.
Especially data-intensive or multimedia applications stand to benefit in situations where local wireless connections fail, for example, Turner said. These capabilities allow programmers to create simple-to-use "drag-and-drop" software that runs both online and offline.
Among the early customers is online auction giant eBay Inc., which plans to announce this week at a conference in Boston that it is using the Apollo programming language to create notification services for its sellers to manage auctions outside of an Internet browser. Sellers also can upload photos or pricing data without constantly being connected to the Web.
Adobe is working with financial-services companies seeking to make it easier for clients to fill out mortgage loan forms when only periodic Web access is available, and with Finetune, an online music store that works offline, too, Turner said.
Apollo, also called Adobe Integrated Runtime (AIR), which means independent software developers can build hybrid Web and desktop applications that run independent of Windows or

Apollo brings to desktop computer programs a way to build rich multimedia applications akin to how Adobe's widely used Flash programming language is used to create Web programs.
Microsoft offers a rival online/offline programming system, including its recently introduced Silverlight framework, which allows Flash-like Web programs to run on local computers.
New features in the test version of Adobe AIR include an embedded local database, the reading of Adobe Acrobat ".pdf" files, expanded JavaScript programming, and deeper integration with Adobe Flex, the company's Rich Internet Application software development system. AIR and Flex are due out commercially in the fourth quarter.
Key elements of Adobe AIR are open source -- meaning that developers are free to use and enhance the code in exchange for sharing any improvements -- including the local database that stores online data offline.
In May, Google said it was working with Adobe to develop its own approach to building software that works both online and offline. Lycos Mail Beta Offers 3GB of Storage
Lycos said Wednesday it had released a beta of the latest version of its Web-based mail service, offering users 3GB of storage and the capability to send unlimited attachments of any size. The company said Lycos Mail is intended for those who need to share large file attachments. In comparison, most other services only permit files of up to 10MB to be attached to e-mails. Lycos said the remaining feature set of the service was essentially the same as the previous version. The webmail ofering is the second service to be imported from parent company Daum Communications of Korea. In October, the service launched Lycos Planet, a version of Daum Planet, which is an interactive networking site.

Google to buy YouTube for $1.6B
Google is in discussions to acquire YouTube Inc. for about $1.6 billion, although the deal is far from done and the talks could collapse, The Wall Street Journal reported on Friday, citing an unnamed source familiar with the matter. Google's reported interest in YouTube would reflect a sense of urgency on the part of the search engine giant to improve its position in the red-hot online video market.
Google entered the market in early 2005, at about the same time YouTube was founded. But so far the success has gone to the scrappy startup, not Google.
In September, YouTube nabbed almost 46 percent of all U.S. visits to video Web sites, while the video section of News Corp.'s MySpace.com came in second with 21.2 percent, according to Hitwise Pty. Ltd. Google Video came in third with 11 percent, followed by Microsoft Corp.'s MSN Video with 6.8 percent and Yahoo Inc.'s Yahoo Video with 5.6 percent.
YouTube, in typical startup fashion, approached the market aggressively, opening up their service to anyone wanting to upload their videos, and quickly became a phenomenon. It embraced tagging and sharing features, creating the most popular online video community.
Meanwhile, Google took a much more conservative approach, at first only featuring videos obtained through formal agreements with professional production houses. Consequently, users had to pay to view many of the videos in the catalogue. Months later, it added an upload feature for regular users, but closely policed submissions. It wasn't until recently that it opened wide the service's door and added tagging and sharing capabilities.
Yahoo, Microsoft and AOL LLC are also playing catch-up to YouTube, whose model these large Internet companies are adopting.
Google, Yahoo, Microsoft and AOL need a strong position in this market, due to the increasing popularity of online video. Collectively, traffic to the top 10 video Web sites increased 164 percent between February and May of this year, according to Hitwise. As traffic to online video sites increases, so does the interest of advertisers, who in turn generate most of the revenue for Google, Yahoo, Microsoft and AOL.
For many years, online video remained an unfulfilled promise, hobbled by high broadband prices, inferior image quality and reluctance by TV networks and film companies to put their shows and movies on the Web. However, in the past 18 months, video on the Web has gained momentum, helped by a critical mass of users with broadband access, improved quality and a willingness by production companies to distribute their films and programs online.
The deal clearly would strengthen Google's position in online video, but it might also saddle Google with potential copyright liability issues, said analyst Greg Sterling of Sterling Market Intelligence, in an interview.
Critics have blasted YouTube for being lax about ridding its catalogue of copyrighted videos uploaded without permission. Some predict entertainment companies will sue YouTube out of business.
Thus, Google needs to walk a fine line between copyright protection and preserving the appeal of YouTube's rich catalogue, Sterling said.
Still, gaining YouTube's audience gives Google an enormous opportunity to boost its fledgling efforts in video advertising, of which it has done very little, Sterling said.
Most of Google's revenue comes from text ads that run along with Web search results. Google is trying to diversify its business with other types of ads, such as banners and video.
However, its video ad efforts have been hurt by Google Video's relatively weak position in the market, Sterling said.
For YouTube, getting bought by Google would mean salvation from death by copyright litigation, wrote Josh Bernoff, a Forrester Research Inc. analyst, on his blog Friday.
Google has the technical resources YouTube lacks to implement a system to automatically detect and remove copyrighted material, Bernoff wrote.
If dealing with lawsuits, Google -- unlike YouTube -- can negotiate with plaintiffs and reach amicable resolutions to ligitation, according to Bernoff. "By itself, I still think YouTube is toast. But with Google -- maybe not," Bernoff wrote.

RealPlayer 11 PREVIEW
Equally new in version 11 is Video CD recording. Any saved video recognized by RealPlayer can be burned as a standard VCD, which works both in a large number of DVD players as well as some playback tools on computers without any version of RealPlayer installed. The paid Plus version will also burn directly to DVD.
Overall performance has been given a boost, Real claims, in terms of load times as well as an improved visual interface and a less intrusive install routine. Support for multiple player-specific formats such as QuickTime and Windows Media will carry over from earlier versions.
A public beta of RealPlayer 11 will be available for free beginning in June, the company says, but at first will require Windows as well as either Firefox or Internet Explorer for viewing and saving web-based streams. A Mac version is promised but will be posted later in the year.
